1. Acceptance of Terms
By accessing or using offer.guide (the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.
2. Description of Service
OfferGuide provides AI-powered property analysis, valuation modeling, and offer strategy recommendations. Our Service covers multiple real estate verticals, including but not limited to:
- •Residential: Existing single-family homes and townhomes.
- •Land & Development: Vacant land, site-prep estimation, and build-feasibility.
- •Investment: Rental property cash-flow analysis and ROI projections.
All analyses are for informational and strategic advisory purposes only.
3. User Accounts & Data Input
To use our service, you must be at least 18 years old and provide accurate information.
Accuracy of Analysis: You acknowledge that the "Analysis Report" is a reflection of the data you provide. OfferGuide is not responsible for valuation errors or strategic failures resulting from inaccurate, incomplete, or outdated information provided by the user (the "Homework").
4. Payments and Refunds
Credits: Credits purchased for individual reports are non-refundable and do not expire.
Subscriptions: "OfferGuide Pro" or Unlimited subscriptions are billed monthly and can be cancelled at any time. Cancellations take effect at the end of the current billing cycle.
Refund Policy: If you are dissatisfied with a report, contact us at legal@offer.guide within 24 hours for a credit replacement or refund at our discretion.
5. Intellectual Property & Trademarks
All content, features, and proprietary logic of the Service are owned by OfferGuide.
Proprietary Frameworks: The OfferGuide Principle™ and the Four Pillars of Value™ (including the specific triangulation of County Anchors, Appreciation Baselines, and Market Comps) are trademarks of OfferGuide. You may not reproduce, reverse engineer, or redistribute our proprietary methodologies without express written consent.
6. Acceptable Use
You agree not to use the service for any illegal purpose, attempt to scrape our data, or share account credentials. Reselling OfferGuide reports to third parties is strictly prohibited unless you are enrolled in a verified "Professional Partner" (MLO/Builder) program.
7. Professional Advice Disclaimer (The "Safety Gates")
OfferGuide is a technology provider, not a professional services firm.
Not an Appraisal: Our reports are NOT licensed appraisals and should not be used as a substitute for a professional appraisal conducted by a certified appraiser.
Not Financial Advice: Investment and ROI projections are for educational purposes and do not guarantee future financial performance or tax benefits.
Land/Engineering Disclaimer: Land reports provide regional cost estimates for site prep (well, septic, clearing). They do not replace professional soil (perc) tests, environmental assessments, or civil engineering surveys.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFERGUIDE SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSSES, INVESTMENT FAILURES, OR DECISIONS MADE BASED ON OUR REPORTS. Our total liability for any claim shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.
9. Third-Party Partners (MLOs and Builders)
OfferGuide may provide links to or integrations with third-party Mortgage Loan Officers (MLOs), Builders, or Real Estate Professionals. We do not act as a broker or lender, and we are not responsible for the services provided by these third parties.
10. Termination
We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
11. Governing Law
These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions.
